Well, I think u should beware of the after auction procedures, as pre-auction procedure is much more simpler, i think.

i m thinkin of buying a property via auction but when i went to see the property , it's occupied ! i read somewhere that it could be tricky getting rid of the tenants ...should I be worried ??

HI I am the 1st time auction buyer, I got a problem with the lawyer already 14 months since I purchased the apartment it is a stalemate so far I paid in advanced my own money the previous owner maintainence fee to get the process running smooth but the bank should pay me back that money,
the bank already issue the cheque, somehow its stuck with my lawyer they keep delaying to send me the cheque I already paid 85% of that lawyer fee
Do this lawyer firm have right to hold the cheque.?

if a auction property is occupied by its owner, and he/she refuse to move out, HOW?
can i change the locks after signing the contract OR do i hav to wait til loan approve???

It is not the correct thing to do. The previous owner has rights and he/she might use legal aid to protect that right. You need to show to the previous owner documents that you have fully settled the payment and that you are now the rightful owner. You need to negotiate with him/her in a lawful way. But you should serve an eviction notice, should you want him/her to leave. Another way is file a police report and get the policeman to investigate. Even if your loan has been approved, you cannot take any action until you have fully settled the purchase price.

Will it be a big problem if I buy low cost flat thru auction? (ie.: consent from state authority takes very long time, there's income limited eligibility etc.)

Can give me more detailed tips/procedure to evict the ex-owner and roughly the cost involved without going to court? What do you mean asking police to investigate? Investigate what? Since i owned (in the future) the property and the ex-owner is staying there illegally, can i press charge him of tresspassing or any other crime related to it?

First time here. How do I know if the auction property maintenance fee will be cover by the bank or I have to paid it. What's the legal clause that i should look into. The property i'm interested to bid has outstanding maintenance fees of close to RM5k.
